Booking Policy

This service is provided by Chris McCann, trading as Kooskoos (referred to as the "Band"), and forms part of the contract to be entered into between you (the Client) and The Band. 
 
General
 
This agreement and booking policy contains the entire understanding between the Band and the Client. It supersedes all prior and simultaneous agreements between the parties. Only changes or modifications specifically placed in writing, attached, dated, and signed by both the Client and the Band at the time of acceptance of this contract shall be recognized as amendments to this contract.
 
By booking and using the Service and/or continually hiring this service, you agree to be bound by this agreement and booking policy. The Band reserves the right, at its sole discretion, to modify this agreement and booking policy at any time. Such modifications take effect when published on www.kooskoos.co.uk or communicated to you in any other appropriate manner.
 
Your continued use of the Service after such modifications constitutes your consent to the changes. Please check the Website regularly to verify whether this agreement or booking policy has been modified. If you do not agree to abide by this agreement or booking policy, you may not use the Service.


 
The Service 

The Band will provide live music entertainment services for the Client's event, including but not limited to weddings, parties, bar/restaurant performances, and corporate events. The Band will perform for the total number of hours agreed upon between the Client and the Band, with a specified starting and ending time (e.g., 8 PM to 10 PM).
 
The Band agrees to play music from the Setlist provided at Setlist, along with any other songs the Client may request, limited to 5 to 10 suggestions. The Band reserves the right to decline playing requested songs for any reason.
 
The Band will supply all necessary equipment for the performance, including but not limited to instruments, amplifiers, microphones, and speakers if required. The Client must inform the Band in writing if certain equipment is not needed (e.g., using an in-house system instead of bringing speakers). The Band will make efforts to ascertain equipment needs for the event and will provide details on any additional costs if necessary.
 
The band is entitled to take breaks during performances. For every 2 hours of playing, the band will need a 15-minute break, and for every additional hour after that, following a similar pattern. For example:
 

  • A 2-hour set will include one 15-minute break.

  • A 3-hour set will have two 15-minute breaks.

  • A 4-hour set could include one 15-minute and one 30-minute break or three 15-minute breaks—whatever works best.
     

This policy follows Musicians' Union guidelines (you can check them out here).
 
If you have specific ideas about the timing of breaks, let us know before the performance, and the band will do their best to accommodate. Just to note - breaks are built into the performance schedule, the set time won’t be extended (e.g., a 7–9 PM set with a 15-minute break will still wrap up at 9 PM).

Service Pricing and Payment Terms
 
The price for the Service will depend on the specific service requested by the Client and agreed upon by the Band.
A Reservation Deposit of 20% of the total agreed fee is required at the time of booking. This deposit must be paid when entering into this agreement and will be applied toward the agreed-upon Service. Dates are reserved only when the Client pays this fee via bank transfer to Chris McCann, trading as Kooskoos.
 
The Band may waive the Reservation Deposit depending on the Client's requested service. The Band reserves the right to request a Reservation Deposit and will inform the Client directly if it is required. If the Band does not request a Reservation Deposit, the Client is not obligated to pay it.
 
If the Client wishes to pay the Service fee in instalments, the Band utilizes the third-party platform GoCardless, available at GoCardless. Clients can cancel payments via this platform at any time; however, the Client must notify the Band before cancellation, as outlined below.

Payment Period
 
The Client understands and agrees that the remaining balance for the Service is payable before the date of the event, up to and including the day of the event, but before the time of the performance. The Band will issue an invoice to the Client.
 
If the balance is not paid within this time frame, the Band reserves the right to cancel the contract, and the cancellation provisions set out below will apply.
 
The Band reserves the right to refuse to perform until the full balance has been paid.
 
At the Band's discretion, they may agree to perform the arranged service and issue the invoice after the event, with a 14-day payment period. Should the Client refer the Band to a 'suppliers form', the Client acknowledges that the 14-day payment period still applies unless otherwise agreed upon by the Band.
 
Cancellation
 
Upon receipt of the Reservation Deposit, the Band will reserve the agreed-upon time and date and will not make other reservations for that period. During this time, the Band may also hire equipment via a third party and/or arrange transport for equipment or rehearsal space. For these reasons, the Reservation Deposit is non-refundable, even if the date is changed or the event is cancelled for any reason, including acts of God, fire, strikes, and/or extreme weather. However, the Band may, at its discretion, choose to refund the deposit.
 
If the Band needs to cancel for any reason, the deposit will be fully refunded to the Client.
If the Client pays via an instalment plan through the GoCardless platform, the Band will fully refund the amount paid, excluding the Reservation Deposit, within 30 days of the agreed-upon event date.

Indemnification 

The Client shall indemnify and hold harmless the Band from any and all claims, damages, liabilities, costs, and expenses arising out of or in connection with the Band's performance of the services under this Agreement, including but not limited to any injury or damage to persons or property.

Damages

The Client shall cover the full payment of repair or replacement costs that arise if any of the band's equipment or equipment hired by the Band is damaged by the Client and/or their party of guests. All damage that is not accidental must be reimbursed.
 
Governing Law 

British law shall apply to this agreement except with regard to principles on conflict of laws. Any dispute, controversy, or claim arising out of or in connection with this agreement, or the breach, termination, or invalidity thereof, shall be determined by British courts of general jurisdiction where the district court of Belfast shall be the court of the first instance.
